Resumen

El presente artículo tiene por objetivo la crítica a la reivindicación del derecho posi-tivo como un instrumento de cambio social en un sentido emancipatorio, caracterizándolo como un instrumento de poder de dominación heteropatriarcal*, capitalista, moderno y colonial —por lo tanto, racista— y sosteniendo que el uso alternativo que de él se haga, especialmente del contenido ético incluído en los derechos humanos re-conocidos, no es suficiente para afirmar que sirvan para emancipar a los sujetos opri-midos. Para ello, se hace el análisis de uno de los grupos sociales más vulnerados en México: las mujeres jornaleras migrantes, para dar cuenta como lo ganado en materia de derechos humanos se ha logrado en lo discursivo, pero no en las conquistas sociales necesarias para evitar la explotación y sufrimiento de grandes grupos de personas.

ABSTRACT

The objetive of this article is to criticize the claim of the positive law as a social change in-strument in an emancipatory sense, characterizing it as an instrument of heteropatriarchal, capitalist, modern and colonial -that is, racist- power of domination and arguing that the alternative use that is made of it, especially of its ethical content encompassed in the recog-nized human rights, are not enough to affirm that they serve to emancipate the oppressed subjects. For this, the analysis of one of the most vulnerable social groups in Mexico ismade: migrant farmhand women, to demostrate how what has been gained in human rights has been achieved in the discursive dimension, but not in the necessary social conquests to avoid the exploitation and suffering of large groups of people.
