Derecho laboral e ideología: el liberalismo y la regulación del trabajo en México: Labour law and ideology: liberalism and the regulation of work in México

Resumen

El presente trabajo pretende analizar las diferencias existentes entre la regulación laboral que surge a partir de la reforma liberal en nuestro país y el intento de Maximiliano y el imperio por generar una regulación jurídico- positiva del mismo. Esto tiene una doble intención: por un lado, mostrar el carácter ideológico que se esconde detrás de la defensa a ultranza tanto de la Ley Federal del Trabajo como de sus posibles reformas y por otro, rastrear el origen de los discursos que presentan a una u otra como “naturales” o “necesarios” para el desarrollo de nuestro país.

Abstract

On the present paper, the author analyzes the differences between the labor regulation
of the classical liberal regimen on México and the attempt of Maximillian of Hapsburg
to create a new positive law about this subject. This has a double intention. On the one
hand, to show the ideological character of both the defense on the Federal Labor Law and their possible reforms; by the other hand, to trace and identify the source of the discourses that present them as “natural” or “necessary” for the country.
