Critica jurídica y feminismo crítico: Legal criticism and critical feminism

Resumen

La teoría feminista forma parte del pensamiento crítico latinoamericano a pesar de que nunca es resaltado. Teoría social y teoría feminista se mueven como líneas teóricas paralelas que no se encuentran, un problema grave que hay que debatir hoy, cuando los gobiernos neoliberales –con las ventajas que da el poder y ayudados por la dialéctica del sexo– pretenden apropiarse del legado feminista. En este trabajo se rebate al feminismo decolonial la propuesta de los géneros no binarios y se recupera y argumenta la teoría feminista como una teoría crítica, capaz de liberar a las mujeres y transformar la realidad social. Se describe el Feminismo crítico surgido en las raíces de la cultura regional anticolonial. Al resaltarse las capacidades creadoras de la teoría del derecho en la región, surge la apuesta para la ganancia de vínculos entre Crítica jurídica y Teoría feminista.

Abstract

The feminist theory is part of the latinoamerican critical thinking, even if this is not sait much. Sociam theory and feminist theory move on paralels ways to never find each other, a deep problem that has to be debated, not tomorrow but today,when the neoliberal governements,with the advantages that the power gives and helped by the gender dialectic,pretend to take possession of the feminist legacy. This work debates the decolonial feminist the no binaries gender proposal and the feminist theory is returned and argued as a critical theory, capable of free women and transform the social reality. The work proposes the critical feminist surged from the anticolonial regional culture.When the creative capabilities of the rihgts theory are stood up,it raises the bets for relations between legal criticism and feminist theory.
