El lugar del derecho en la tradición socialista. Jalones de una historia compleja: The place of law in the socialist tradition. Milestone in a complex history

Resumen

El artículo presenta un análisis centrado en la observación histórico-conceptual de una tradición socialista previa pero también paralela al marxismo, la cual se encuentra vinculada con la importancia del derecho en la trasformación social. Así, a través de esta observación, se distinguen diversas teorizaciones entretejidas acerca de las relaciones que establece el socialismo con el derecho, mostrando con ello su complejidad cambiante en cada época y corriente de pensamiento, lo que resulta inexorable ante un contexto de emergencia de saber jurídico autónomo, incluso para la teoría marxista del derecho, aunque al mismo tiempo representa la posibilidad de renovación hacia un socialismo del siglo XXI.

ABSTRACT

The article presents an anallysis focused on the historical- conceptual observation of a previous socialist tradition but also parallel to marxism, which is linked to the importance of law in social tranformation. Thus through this observation, various interwoven theorizations about the relationships that socialism established with the law are distinguished, showing their changing  complexity at each time and current of thought, which is inexorable in the face of an emergency context of autonomous legal knowledge, even for the marxist theory of law, although at the same time it represents the possibility of renewal towards a 21st century socialism.
