Abstract

Este trabajo enfatiza aspectos jurídicos del problema de los derechos humanos de las comunidades indígenas. I. Derechos humanos de los pueblos indios. II. Demandas a nivel del derecho positivo nacional. III. Existencia y vigencia del derecho indígena y su uso alternativo. IV. Desarrollo democrático de América Latina. V. A manera de epílogo.

Abstract

This work observes the matter in human rights affairs of indigenas communities, from an interdisciplinary point of view. The purpose is to make enfacize the juridical aspects. I. Human rights of indigenas conununities. II. Memmorials from a positice international law. III. Existence and vigency of indian law and its altemative usage. IV. Democratic development in Latinamerica and V. Balance and perspectives. This work searches to demonstrate the unadjudjment between the institutional regime ruled by Latinamerican States and juridical practice inside indigenas communities. As well as the internal matter and the etnias affairs, do require democratic foundation of the national State.
