Resumen

O presente artigo tem como objeto discutir a (aparente) dicotomia, estabelecida na XI Glosa de Marx ad Feuerbach entre interpretar e ou transformar o mundo, aplicando-a, no que concerne a teoria do direito, a tensão entre descrever a realidade social ou prescrever como ele deveria ser. Tal paralelo será explorado dado que a originalidade dessa glosa consistiu em criticar as filosofias meramente especulativas. Tem, enquanto problema, indagar se tal crítica significaria abrir mão do “conhecer” em nome do “transformar”, ou seja, lidar com crenças ao invés do lidar com os fatos. A hipótese é a de que é impossível compreender a sociedade ou o processo de seu estabelecimento, sem, primeiramente, se compreender o am-biente e os conflitos desta mesma sociedade. Quanto a metodologia far-se-á uso do método dialético de Marx e Engels.

ABSTRACT

The object of this paper is discuss an apparent dichotomy established in Marx's 11th Thesis against Feuerbach between interpreting and / or transforming the world, applying it, as far as the Jurisprudence is concerned: the tension between describing social reality (is) or prescribing as it should be (ought). The parallel will be explored since the originality of this thesis consisted in criticizing the philosophies merely speculative. It has as question to ask whether such criticism would mean giving up "knowing" in the name of "transforming", that is, dealing with beliefs rather than dealing with the facts. The hypothesis is that it is impossible to understand the society or the process of its establi-shment, without, first, understanding the environment and the conflicts of this same society. As for the methodology, use will be made of the dialectical method of Marx and Engels.
