Nuevas teorías constitucionalistas y poder constituyente. ¿Armas de (re)emancipación en el contexto de la globalización neoliberal? New constitutional theories and constituent power. Weapons of (re) emancipation in the context of neoliberal globalization?

Resumen

Dentro del contexto de avance del esquema económico neoliberal, y tras la crisis global de 2007-2008, han quedado claro los efectos perniciosos de la ausencia de mecanismos efectivos de control estatal, especialmente con los derechos. En este contexto, algunas posturas críticas dentro del Derecho han pretendido reconfigurar el rol del constitucionalismo: el constitucionalismo popular, el neoconstitucionalismo y el nuevo constitucionalismo latinoamericano, acompañados de procesos constituyentes, han permitido discutir al clásico constitucionalismo, potenciando la efectividad y justiciabilidad de los derechos y la instalación de diversos mecanismos de democracia participativa. Este artículo pretende dar un panorama de estas corrientes, y una evaluación de su incidencia teórica y práctica.

Abstract

Within the context of the advance of the neoliberal economic scheme, and after the global crisis of 2007-2008, the pernicious effects of the absence of effective mechanisms of state control, especially with rights, have become clear. In this context, some critical positions within the Law have tried to reconfigure the role of constitutionalism: popular
constitutionalism, neo-constitutionalism and the new Latin American constitutionalism, accompanied by constituent processes, have allowed the classic constitutionalism to be discussed, enhancing the effectiveness and justiciability of the rights and the installation
of diverse participatory democracy mechanisms. This article aims to give an overview of these currents, and an assessment of their theoretical and practical impact.
