Contribución de Oscar Correas a la Crítica Jurídica: entre el pensamiento jurídico crítico y el derecho crítico: Contribution of Oscar Correas to Legal Criticism: between critical legal thought and critical law

Resumen

La Crítica Jurídica se presenta como inconfundible con el pensamiento jurídico crítico o con el derecho crítico que remite al autopoiético, pues no hay derecho como un sujeto sino como objeto de la crítica. Por otro lado, la Crítica Jurídica se singulariza por su denominación precisa, especificada casi a la par de su origen en América Latina, durante el periodo álgido de los regímenes militares, situación que dio pauta a cuestionar la relación estado, derecho y sociedad hasta llegar, entre otros puntos, al núcleo normativo analizado mediante el método sociosemiológico, desarrollado por Óscar Correas, logrando con ello observar diversos aspectos como la ideología subyacente, la pluralidad normativa cualitativa y la relación derecho y poder. En este sentido, el método referido, sin ser la única contribución para una Crítica Jurídica, se coloca como relevante al tratarse de una herramienta epistémica aplicable al análisis de todo derecho, de ahí que se considere insoslayable incluir esta contribución en la enseñanza jurídica en la Teoría del Derecho.

Abstract

Legal Criticism is presented as unmistakable with critical legal thought or with critical law that refers to the autopoietic, since there is no law as a subject but as an object of criticism. On the other hand, the Legal Criticism stands out for its concrete name, specified almost at the same time as its origin in Latin America, during peak period, of the military regimes, a situation that gave rise to the questioning of the relationship between the state, law and society until it reached, among other points, the normative nucleus analyzed through the sociosemiologic method, developed by Oscar Correas, thus managing to observe diverse aspects such as the underlying ideology, the qualitative
normative plurality and the relationship between law and power. In this sense, the method referred to, without being the only contribution to a legal criticism, is placed as relevant as it is an epistemic tool applicable to the analysis of all law, hence it is considered essential to include this contribution in legal education in the Theory of Law.
