Querido Óscar: Más acá o más allá de Pashukanis: Dear Oscar: With or Beyond Pashukanis

Resumen

El presente artículo es una colaboración para el Dossier sobre la teoría de la crítica jurídica de Óscar Correas Vázquez que formará parte de la publicación del número 2 de la Revista Crítica Jurídica Nueva Época, en el contexto de celebrarse el 35 aniversario de la fundación por él de la revista. El texto del artículo recoge, entre otras cosas, el contenido de un intercambio epistolar fraternal, vía correo electrónico, que hubo en julio de 2012 entre Correas y el autor en torno a las ideas del jurista bolchevique Evgueni Pashukanis sobre el derecho y el estado, así como la pertinencia de éstas para comprender el impulso contemporáneo de una normatividad societal y comunal o no-derecho que ha irrumpido, con propósitos contestatarios, más allá del derecho estadocéntrico. Mientras Correas insiste en la tesis kelseniana de que no hay un afuera del derecho, Rivera Lugo coincide con Pashukanis sobre la especificidad histórica, como modo clasista de regulación social, de la forma jurídica bajo el capitalismo y la necesidad histórica de transitar hacia una nueva forma de normatividad comunizante y transcapitalista.

Abstract

The present article is a contribution for the Dossier dedicated to the critical legal critique of Oscar Correas-Vázquez that will appear as part of the publishing of the second number of the Journal Crítica Jurídica Nueva Época, founded by Correas, in the context of the Journal’s 35th anniversary. The text of the article centers around, among other things, the fraternal exchange, in July of 2012, via email, between Correas and the author regarding the ideas of the Bolshevik jurist Evgeny Pashukanis on the Law and the State, as also their pertinence for understanding the contemporar impulse of societal or communal normativity or non-Law, beyond state-centered Law, that has erupted as the result of struggles. While Correas insists in Kelsen’s thesis that there is no outside of the Law, Rivera Lugo agrees with Pashukanis on the historical specificity of the legal form, as a classist mode of social regulation, under Capitalism and the historical need to transition to a new communal and transcapitalist normative form.
