Resumen

Frente a la apología incuestionable del Estado y el discurso de los derechos humanos, resulta necesaria una perspectiva Crítica que coadyuve a comprender sus efectos políticos. La primera parte del trabajo aquí presentado, inicia con los planteamientos en torno a la naturaleza lingüística de los derechos humanos y su instrumentalidad dominante planteados por Óscar Correas en su obra “Acerca de los Derechos Humanos. Apuntes para un ensayo”. La segunda parte del ejercicio Crítico, pretende establecer un enfoque disruptivo en torno al fenómeno lingüístico antes enunciado, apuntando necesaria la tarea de un cuestionamiento radical de la unidad ficticia del orden jurídico.

Abstract

Faced with the unquestionable apology of the State and the discourse of human rights, a Critical approach is needed that helps to understand its political effects. The first part of the work presented here, begins with the approaches about the linguistic nature of human rights and its dominant instrumentality raised by Óscar Correas in his work “Acerca de los Derechos Humanos. Apuntes para un ensayo”. The second part of the critical exercise, aims to establish a disruptive approach around the linguistic phenomenon before the statement, pointing to the task of a radical questioning of the fictitious unity of the legal order.
